Terms of service
Prop Department Terms of Service
Effective date: 10/4/2026
These Terms of Service ("Terms") govern your use of www.propdepartment.com and purchases made through it (together, the "Services"). The Services are operated by Prop Department LLC, doing business as Prop Department ("Prop Department," "we," "us," or "our").
Please read these Terms before using the Services. By affirmatively accepting these Terms, including when placing an order through a checkout that presents them for acceptance, you agree to them. If you do not agree, do not place an order or use Services that require acceptance.
1 Eligibility and accounts
To place an order or create an account, you must be at least the age of legal majority where you live and capable of entering a binding agreement. A parent or legal guardian may make purchases for a minor. If you act for a business, you represent that you have authority to bind it.
Provide accurate contact, billing, and shipping information and keep your account information current. Protect your login credentials and notify us promptly of suspected unauthorized access. You are responsible for activity you authorize through your account; these Terms do not make you responsible for unauthorized activity where applicable law provides otherwise.
2 Products and descriptions
We may offer apparel, gloves, accessories, other merchandise, and digital products or courses. Product pages identify the features, sizing, contents, price, and any applicable restrictions. Images are illustrative; colors may vary by display, and reasonable manufacturing variations may occur. These variations do not excuse materially inaccurate descriptions or defective products.
Availability may change. We may discontinue products or limit quantities for legitimate reasons, including inventory constraints, suspected fraud, or unauthorized bulk purchasing. Changes do not remove our obligations for orders already accepted.
3 Orders prices and payment
Prices, currency, and applicable charges are displayed before you submit your order. You authorize us and our payment providers to charge the payment method you supply for the disclosed total. You represent that you are authorized to use that payment method. Price changes apply to future orders.
An automated order receipt acknowledges your order. We accept an order when we confirm shipment of physical goods or provide access to digital goods, unless we expressly confirm acceptance earlier. Subject to applicable law, we may reject or cancel an order because of unavailability, suspected fraud, payment failure, or an obvious pricing or description error. We will notify you and promptly refund amounts paid for canceled items. We will not increase the price of an existing order without your agreement.
4 Promotions and discount codes
Promotions may have separate eligibility requirements, expiration dates, exclusions, minimum purchase amounts, or redemption limits, which will be disclosed with the offer. Unless an offer expressly states otherwise, discount codes cannot be combined or applied to previous purchases and have no cash redemption value, except where required by law. The specific terms disclosed with a promotion control over inconsistent general terms for that promotion.
We may refuse a discount obtained through fraud, unauthorized distribution, or circumvention of disclosed limits. If an issue affects an order already placed, we will notify you and will not charge an increased amount without your agreement. Changes to an offer will not retroactively remove a discount validly applied to an accepted order. Sweepstakes and contests, if offered, will have separate official rules.
5 Shipping delivery and order changes
Our Shipping Policy explains available destinations, shipping charges, and processing and delivery estimates. Any preorder or made-to-order shipment timeframe will be disclosed before purchase. Carrier delivery estimates are estimates unless expressly guaranteed.
For physical merchandise, we will ship within the timeframe stated at purchase or, if none is stated, within 30 days after receiving a properly completed order. If we cannot ship on time, we will provide the required delay notice and cancellation option, obtain any legally required consent to the delay, and issue a prompt refund when required. Carrier disruptions do not eliminate your statutory rights.
Check your delivery address before ordering. Contact us promptly to request a correction or cancellation; we may be unable to make changes after fulfillment begins. Contact us about missing, damaged, or incorrect deliveries so we can investigate and provide an appropriate remedy. A carrier delivery scan does not, by itself, eliminate rights provided by law.
If international shipping is offered, any responsibility for import duties, taxes, and customs charges will be disclosed before purchase. Nothing in these Terms shifts charges to you that applicable law requires us to pay or disclose differently.
6 Returns refunds and exchanges
Our Return and Refund Policy, as presented when you order, governs voluntary returns and exchanges, including eligibility, deadlines, and return shipping costs. Any final-sale restriction must be clearly disclosed before purchase. Contact us before sending a return so we can provide the correct instructions and address.
These policies do not limit rights relating to defective, damaged, misdescribed, or undelivered products, or any cancellation, refund, warranty, or other rights that cannot legally be excluded. Changes to a policy do not retroactively reduce the rights attached to an existing purchase.
7 Digital products and courses
This section applies only when you purchase or access digital products, including downloads, plans, files, videos, or courses. Unless the product page expressly grants broader rights, your purchase gives you a limited, nonexclusive, nontransferable license for your own personal, noncommercial use. You may make reasonable personal backup copies of downloadable files. Ownership of the underlying intellectual property remains with us or our licensors.
Do not resell, redistribute, publicly upload, sublicense, share paid account access, or remove ownership notices from digital products. A product-specific license may expressly permit commercial use or other additional uses. Uses permitted by applicable law remain permitted.
The product page will identify material technical requirements, delivery method, and any access period or usage limits. Ongoing hosting, updates, support, certification, or particular outcomes are included only if expressly stated. If we cannot provide paid access as promised, we will provide an appropriate remedy under the purchase terms and applicable law. Digital refund restrictions apply only as disclosed before purchase and as permitted by law. Where immediate digital delivery requires separate consent or acknowledgment concerning withdrawal rights, we will obtain it separately.
8 Product use and project content
Follow the product instructions, care guidance, warnings, and stated limitations. Do not assume that apparel, gloves, accessories, or other merchandise are certified protective equipment or rated for a particular hazard unless the product description expressly says so. Nothing here changes a product specification, express warranty, or a legal obligation concerning product safety.
Our videos, articles, demonstrations, and project materials may depict specialized equipment, modified vehicles, experiments, or hazardous activities. Entertainment and general educational content is not an individualized engineering assessment, safety certification, or substitute for qualified supervision. A demonstration does not establish that an activity is safe, lawful, or suitable for your circumstances. Do not attempt a hazardous activity without appropriate expertise, equipment, and precautions. No project result or outcome is guaranteed.
9 Intellectual property
The Services and their original text, graphics, designs, logos, photographs, videos, and other content are owned by Prop Department or its licensors and protected by applicable intellectual property laws. Except for the licenses expressly granted here, you receive no ownership or license to our intellectual property. You may browse the website and use ordinary sharing features for their intended purpose. Other reproduction, sale, or exploitation requires permission unless permitted by law. Purchasing merchandise does not transfer rights in its artwork or branding.
10 Reviews and other submissions
If you submit a review, comment, or other content for public display, you retain ownership and grant us a nonexclusive, royalty-free license to host, reproduce, format, and display that submission in connection with the Services and the relevant product. This license does not transfer ownership of your submission. Separate permission is required for uses beyond this scope, such as featuring your photograph in an unrelated advertising campaign.
Submit only content you have the right to share. Do not submit unlawful material, threats, others’ private information, or deceptive reviews. Disclose material connections, including free products or incentives, when required. We may moderate content for these reasons but will not prohibit or penalize honest reviews merely because they are negative. These Terms do not restrict lawful consumer complaints or communications with regulators.
11 Acceptable use and automated access
Do not use the Services to commit fraud, infringe others’ rights, distribute malware, bypass access controls, interfere with operation or security, or collect others’ personal information without authorization. Do not impersonate another person or misuse payment information.
Do not send spam, phishing messages, or threats through the Services. Automated tools must not overload the Services, scrape nonpublic information, access accounts without authorization, defeat purchase limits, manipulate inventory or checkout availability, or bypass CAPTCHAs, authentication, or other security controls. We may reasonably restrict or block automated activity that violates these requirements. Authorized integrations, legitimate search indexing, accessibility tools, and customer-authorized shopping assistants are permitted when they comply with these Terms and applicable access restrictions. You remain responsible for actions you authorize a tool to perform on your behalf, subject to applicable law.
12 Third party services and links
We may provide access to third-party tools, integrations, and external websites. Separate third-party services may have their own terms and privacy practices. Links do not imply endorsement, and we do not control external sites or independently operated tools. Review their terms before using them. To the extent permitted by law, we do not warrant the availability or accuracy of independently operated third-party services. Using providers does not remove our obligations to you as the seller.
13 Privacy and communications
Our Privacy Policy explains how personal information is collected, used, and shared. We may send communications necessary to process orders, provide access, or maintain your account. Agreement to these Terms does not by itself enroll you in marketing emails or text messages. Marketing preferences and any required consent are handled separately.
Shopify also collects and processes personal information in connection with hosting and providing the Services. Depending on the feature you use, Shopify’s Consumer Privacy Policy (https://www.shopify.com/legal/privacy/app-users) may also apply. Our Privacy Policy explains the relevant sharing with Shopify and other providers, including international processing where applicable. Please review these policies for details; these Terms do not substitute for consent where separate consent is required.
14 Disclaimers and limits of liability
TO THE EXTENT PERMITTED BY LAW, THE WEBSITE AND FREE INFORMATIONAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER DOES NOT APPLY TO EXPRESS PRODUCT PROMISES OR EXCLUDE WARRANTIES OR CONSUMER GUARANTEES THAT CANNOT LAWFULLY BE EXCLUDED.
TO THE EXTENT PERMITTED BY LAW, PROP DEPARTMENT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES ARISING FROM THE SERVICES, INCLUDING LOST BUSINESS PROFITS OR LOST BUSINESS OPPORTUNITIES. SUBJECT TO THE EXCEPTIONS BELOW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THAT CLAIM.
These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by our negligence, liability under applicable product liability law, or any liability that cannot legally be limited. They do not reduce refunds, repairs, replacements, statutory damages, or other mandatory remedies you are entitled to receive. If your jurisdiction does not permit a particular exclusion or limit, that provision applies only to the extent allowed there.
15 Indemnification
To the extent permitted by law, you agree to indemnify Prop Department and its officers, directors, and employees against reasonable losses, damages, and legal costs payable in connection with a third-party claim, but only to the extent caused by your unlawful conduct, your knowing infringement of another person’s intellectual property or privacy rights, or your fraudulent or intentionally abusive use of the Services. This obligation does not arise merely from ordinary browsing, a lawful purchase, an honest review, or the good-faith exercise of consumer rights. It does not cover losses caused by our negligence, misconduct, breach of these Terms, or failure to meet our legal obligations.
We will promptly notify you of a claim for which we seek indemnification and reasonably cooperate in its defense. A delay in notice reduces your obligation only to the extent it materially prejudices your defense. You may control the defense using reasonably qualified counsel, and we may participate with our own counsel at our own expense. Neither party may settle a claim in a way that admits fault by, imposes obligations on, or fails to fully release the other party without that party’s written consent, not to be unreasonably withheld. If you do not undertake the defense after reasonable notice, we may defend the claim and seek reasonable covered costs, subject to these limitations.
16 Suspension and termination
We may restrict or suspend access where reasonably necessary to address a material breach of these Terms, fraud, security threats, or legal requirements. When practical and appropriate, we will give notice and an opportunity to resolve the issue. Any restriction of paid access must be proportionate and consistent with applicable law. Suspension or termination does not eliminate earned refund rights, our duties for existing orders, or your responsibility for lawful amounts already owed. Provisions that by their nature should continue, including ownership and applicable liability provisions, survive termination.
17 Governing law and disputes
These Terms are governed by the laws of Tennessee, USA, without regard to conflict-of-law rules, except that mandatory protections under the laws of your place of residence remain available where applicable. Contact us using the details below if you have a concern so we can try to resolve it. Contacting us first is encouraged but does not prevent you from filing a claim, using small claims court, or contacting a regulator. These Terms do not require binding arbitration or waive participation in a class action. Courts with jurisdiction under applicable law may hear disputes.
18 Changes and general provisions
We may update these Terms prospectively and will revise the effective date when we do. For material changes affecting an ongoing account or paid service, we will provide reasonable advance notice and obtain consent when required by law. Changes do not retroactively alter completed purchases or existing disputes. The terms presented and accepted at purchase continue to govern that purchase unless you agree otherwise.
These Terms and the purchase policies expressly referenced here form the agreement for the Services. Specific product terms disclosed and accepted before purchase control over inconsistent general terms for that product. Mandatory law controls over any conflicting provision. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver of future enforcement.
19 Assignment
We may transfer these Terms and the related rights and obligations as part of a merger, reorganization, or sale of the business or relevant assets, provided the successor assumes our obligations and the transfer does not reduce your existing contractual or mandatory consumer rights. We will provide notice where required by law. Any associated transfer of personal information remains subject to applicable privacy law and our Privacy Policy. You may not sell or transfer an account or a personal digital license without our written consent, except where applicable law permits the transfer. This restriction does not prevent lawful gifting or resale of physical merchandise.
